Terms of Service

These Terms of Service (“Terms”) govern your use of the website located at https://mobilesms.io (“Site”), the mobile application MobileSMS.io (“App”), our Application Programming Interfaces (“API”), and any related products and services (collectively, the “Services”) provided by Reliable Channel LLC (“Company”, “we”, “us”, “our”).
By accessing or using the Services, you agree to be bound by these Terms and to comply with all applicable laws and regulations. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
We reserve the right to review and amend these Terms at our sole discretion by posting updated Terms. Any changes take effect upon posting unless otherwise stated.
0. Definitions
- “Credits” means prepaid usage units that allow you to access certain features of the Services (e.g., renting a temporary number).
- “Temporary Number” means a phone number made available to you for short-term use for receiving SMS, which may be recycled/reassigned.
- “Message” means an SMS message received by a Temporary Number and related metadata (e.g., timestamp, sender number, delivery status).
1. User Eligibility and Account Security
1.1 Age Requirement
The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.
1.2 Account Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
1.3 Identity Verification
We reserve the right to request proof of identity, business information, or ownership of payment methods to prevent fraud. Failure to provide such documentation upon request may result in the suspension or termination of your account.
2. Credits, Payments, Taxes, and Refunds
2.1 Credit System
To utilize the Services (e.g., to rent a temporary phone number), you must purchase “Credits.” You acknowledge and agree that:
- Credits are a limited, non-transferable, non-exclusive, revocable license to use the features of our Services.
- Credits have no monetary value and do not constitute a personal property right, a bank account balance, or real currency.
- Credits cannot be transferred to other users or withdrawn as cash.
2.2 Pricing
We reserve the right to change the price of Credits or the Credit cost required to rent phone numbers at any time without prior notice, except as required by applicable law.
2.3 Taxes
Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any applicable taxes associated with your purchase, except taxes based on our net income.
2.4 Refund Policy
Except where required by law, all purchases are final and non-refundable, except as expressly provided in our Refund Policy (“Refund Policy”), which is incorporated into these Terms by reference.
If you request a refund within seven (7) calendar days of purchase and we determine that the Services failed to perform as advertised due to a material issue within our systems (not due to third-party platform filtering, carrier actions, user error, or prohibited use), we will refund your payment in full to the original payment method.
The 7-day guarantee is void if you violate these Terms or the Acceptable Use Policy, initiate a chargeback/payment dispute, or engage in abuse (as determined by us in our sole discretion). Refund eligibility may also be limited to one refund per customer/account/payment method, to the extent permitted by law.
2.5 Service Failures (Credit Return)
If a temporary number rented through our Service fails to receive an SMS code within the stated activation period (e.g., 10 minutes), the Credits used for that specific transaction will be returned to your MobileSMS.io account balance (where available based on feature rules at the time). This return of Credits is your sole and exclusive remedy for that individual transaction’s service failure.
2.6 Expiration / Inactivity
We reserve the right to expire and remove unused Credits from your balance if your account remains inactive (no logins or transactions) for a period of twelve (12) months, except where prohibited by law.
2.7 Payment Disputes and Chargebacks
Initiating an unwarranted chargeback or payment dispute may result in immediate suspension or termination of your account. We may provide transaction information, logs, and usage evidence to payment processors to contest disputes.
2.8 Refund Policy Controls
If there is any conflict between these Terms and the Refund Policy regarding refunds, the Refund Policy will control solely with respect to refunds. All other Terms remain in effect.
3. Service Availability and Disclaimers
3.1 Temporary Nature of Service
You acknowledge that the phone numbers provided are temporary and may be recycled or reassigned. You should not use these numbers for long-term verification, banking, medical, government services, legal notices, or any service requiring persistent access. We are not responsible for any loss of access to third-party accounts resulting from the loss, recycling, or reassignment of a temporary number.
3.2 Carrier Filtering and Compatibility
While we strive to provide high-quality numbers (including “real SIM” numbers), telecommunications networks and third-party platforms (e.g., Google, Facebook, WhatsApp, Telegram) frequently update their security filters. We do not guarantee that our numbers will be compatible with every third-party service or platform at all times, even if a number previously worked.
3.3 No Resale
Unless expressly authorized by us in writing, you agree not to reproduce, duplicate, copy, sell, resell, sublicense, or exploit any portion of the Services, use of the Services, or access to the Services.
3.4 No Ownership / No Property Rights in Numbers
All phone numbers made available through the Services are provided as part of a limited, revocable, non-transferable service license. You do not own, purchase, or acquire any property rights in any Temporary Number. Temporary Numbers remain controlled by us and/or our upstream providers and underlying carriers.
3.5 No Port-Out / No Transfer
Porting numbers out of the Services is not supported. You acknowledge and agree that you will not be able to port, transfer, assign, or move a Temporary Number to another provider, carrier, platform, or person. Any request to port out may be denied in our sole discretion, except where required by applicable law.
3.6 Reassignment / Replacement / Loss of Number
We may reclaim, replace, recycle, or reassign Temporary Numbers at any time, including for operational reasons, fraud/abuse prevention, upstream provider or carrier requirements, or legal compliance. You may permanently lose access to a Temporary Number and any Messages sent to it.
3.7 Checkout & In-Product Disclosures; Acknowledgment
To help prevent account loss and misuse, we may present important warnings and disclosures within the Services (including at checkout, in the App, on the Site, in the dashboard, and/or via email) (“Service Disclosures”). Service Disclosures are incorporated into these Terms by reference. By completing a purchase, renting a number, or continuing to use the Services after a Service Disclosure is presented, you acknowledge and agree that:
- Temporary / recycled numbers. Numbers are temporary and can be recycled or reassigned at any time.
- No ownership / no property right. You do not own any number provided through the Services and you acquire no property rights in it.
- No port-out / no transfer. Porting numbers out is not supported. You will not be able to port, transfer, assign, or move a number to another provider or person, except where required by applicable law.
- Not for critical uses. Do not use the Services for banking/financial accounts, government services, medical services, legal notices, or any mission-critical or emergency use, and you are responsible for maintaining alternate recovery methods for third-party accounts.
- Third-party acceptance not guaranteed. We do not guarantee any number will be accepted by any specific third-party platform for verification or account recovery.
4. Acceptable Use
Your use of our Services is subject to our separate Acceptable Use Policy (“AUP”), which is incorporated into these Terms by reference. You agree not to use our Services for any unlawful, abusive, or prohibited activities outlined in that policy, including but not limited to fraud, harassment, spam, unauthorized access, or creating accounts for illegal purposes.
Violating the Acceptable Use Policy may result in the immediate termination of your account and forfeiture of any remaining Credits without refund, to the extent permitted by law.
5. Intellectual Property
The intellectual property in the materials contained in the Services (including source code, databases, software, website designs, audio, video, text, photographs, and graphics) are owned by or licensed to Reliable Channel LLC and are protected by applicable copyright and trademark law.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. This license shall automatically terminate if you violate any of these restrictions or these Terms.
You may not reverse engineer, decompile, or attempt to extract source code from the Services except to the extent permitted by applicable law.
6. Limitations of Liability and Disclaimer
6.1 “As-Is” Service
THE SERVICES ARE PROVIDED ON AN ‘AS IS’ AND ‘AS AVAILABLE’ BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, RELIABLE CHANNEL LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 Limitation of Damages
IN NO EVENT SHALL RELIABLE CHANNEL LLC OR ITS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE LOSS SUFFERED OR INCURRED BY YOU OR ANY THIRD PARTY (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING FROM THE USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGE.
6.3 Liability Cap
NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF ACTION WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE THREE (3) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
7. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) breach of these Terms; (3) any breach of your representations and warranties; or (4) your violation of the rights of a third party, including but not limited to intellectual property rights.
8. Dispute Resolution (Binding Arbitration)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
8.1 Informal Negotiations
To expedite resolution and control the cost of any dispute, the Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.
8.2 Binding Arbitration
If the Parties are unable to resolve a Dispute through informal negotiations, the Dispute will be finally and exclusively resolved by binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”). The arbitration will take place in Tarrant County, Texas, unless otherwise required by applicable law.
8.3 Class Action Waiver
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. TO THE FULL EXTENT PERMITTED BY LAW: (A) NO ARBITRATION SHALL BE JOINED WITH ANY OTHER PROCEEDING; (B) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS OR TO UTILIZE CLASS ACTION PROCEDURES; AND (C) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.
8.4 Injunctive Relief
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorized use, security breaches, or infringement of intellectual property.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
10. Modifications and Interruptions
We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. We are not liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime.
11. Miscellaneous
11.1 Force Majeure
We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control, including but not limited to acts of God, war, strikes, embargoes, government orders, internet failures, or failure of telecommunications networks.
11.2 Severance
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
11.3 Entire Agreement
These Terms and any policies or operating rules posted by us on the Services (including the AUP and Privacy Policy) constitute the entire agreement and understanding between you and us.
11.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
12. California Users and Residents
If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.
13. Site Disclosures
13.1 Affiliate Disclosure
The Site and App may contain links to affiliate websites, and we may receive an affiliate commission for any purchases made by you on the affiliate website using such links. Our affiliates include, but are not limited to, Multilogin and Decodo.
13.2 Testimonials Disclosure
The Site may contain testimonials by users of our products and services. These testimonials reflect the real-life experiences and opinions of such users. However, the experiences are personal to those particular users and may not necessarily be representative of all users of our products and services. We do not claim, and you should not assume, that all users will have the same experiences. Your individual results may vary.
